— Ss. 374, 386 and 401 — Appeal before High Court against conviction — Dismissal without examining merits — Appeal dismissed only on ground that criminal revision petition filed by informant had been dismissed and the revision and the appeal related to the same judgment — Case of the appellants not examined independently on merits — Held, merely because revision petition filed by informant was dismissed, that could not have been a ground for not discussing merits of the appeal filed by appellants — Revision petition may have been without merits but that would not make the appeal meritless — Matter sent back to High Court for fresh consideration on merits, (2006) 5 SCC 674
