Criminal Procedure Code, 1973

— Ss. 438 and 125 — Anticipatory bail — Grant of, by High Court by imposing condition that accused would pay to the victim daughter-in-law a sum of Rs 2000 per month as maintenance — Propriety of — Held, was not proper — Accused who were jeth and jethani (elder brother-in-law and co-sister) of the victim could not be made liable to deposit the said amount for maintenance of victim — While deciding bail application, the court had no jurisdiction to decide civil disputes as between the parties — Hence, matter remitted to High Court for consideration afresh on merit — High Court to pass appropriate order without imposing any condition of the nature imposed herein, (2006) 6 SCC 196-A
