— Upgradation of pay — Entitlement to — Respondent working as Transmission Executive in All India Radio, which was then a part of Broadcasting Ministry of Govt. of India — He took voluntary retirement on 31-7-1997 — Prasar Bharati came into existence w.e.f. 23-11-1997 by virtue of the Prasar Bharati (Broadcasting Corporation of India) Act, 1990 — S. 11 of the Act required option to be called for from employees working in AIR and Doordarshan for transfer from Central Govt. to Prasar Bharati — No final decision in these matters had been taken, though w.e.f. 23-11-1997 some employees were deemed to have been sent on deputation to Prasar Bharati — Memorandum dated 25-2-1999 issued by the Broadcasting Ministry upgrading pay scales of ``existing employees'', working or ``currently in service'' of Prasar Bharati — Respondent, having taken voluntary retirement even before Prasar Bharati came into existence, held, not entitled to upgraded pay under the said memorandum, (2006) 6 SCC 236
